With a valid residence card, you can travel and stay in the Schengen area countries for a period not exceeding 90 days within each 180-day period, provided the foreigner has a valid travel document, a justified purpose of stay, and sufficient means of support for the entire period of stay.
Currently, a permit is issued for a period of 1 to 3 years. The residence card is issued for a similar period as your decision.
NO. All third-country nationals subject to the visa requirement entering the territory of the Republic of Poland must have a valid travel document and a valid visa or residence card confirming the right to legal entry and stay in Poland. Therefore, as a rule, a residence decision is not a document entitling entry into the territory of the Republic of Poland.
A foreigner can take up employment in Poland if they have a work permit or a declaration of entrusting work performance and have a visa, except for a visa issued for:
- Tourism – symbol “01”,
- Taking advantage of temporary protection – symbol “20”,
- Arrival for humanitarian reasons, due to the interest of the state or international obligations – symbol “21”.
If you are not satisfied with the decision in your case, you can appeal against any decision within 14 days of receiving it.
Yes. A complaint to the Voivodeship Administrative Court is available against the decision of the second-instance authority within 30 days from the date of receiving the decision. However, remember that even if the Court agrees with you, it does not mean that it will issue a decision on a temporary residence permit. The Court, by setting aside the decision of the second-instance authority, will return the case file to the authority for reconsideration. If the Court does not share your opinion, you can file a Complaint to the Supreme Administrative Court. The entire procedure, depending on the location, can take several years.
An application for a temporary residence permit should be submitted on the last day of your legal stay in the territory of the Republic of Poland.
The first temporary residence permit for the purpose of studying is granted to a foreigner who undertakes studies in the territory of the Republic of Poland in the first year, for a period of 15 months. In the case where the studies are covered by a European Union program or a multilateral program that includes mobility funds, or an agreement between at least two higher education institutions providing for intra-Union mobility, the first permit is granted for a period of 2 years.
If the studies justify the foreigner’s stay in the territory of the Republic of Poland for a period shorter than 1 year, the first permit is granted for the duration of the academic year or studies, extended by 3 months.
Subsequent temporary residence permits for the purpose of studying are granted for the period of study, extended by 3 months, but not longer than 3 years.
